Sedation: Loss of support claim

Thapelo was a healthy 27-year-old who had to undergo removal of his wisdom teeth. The procedure was scheduled to be done under sedation by his dentist at the dental practice. Something went terribly wrong with the sedation and Thapelo suffered a heart attack and died on the way to the hospital. He was survived by his wife, Lerato who was 30 weeks pregnant as well as their 3-year-old little girl. Lerato and the children had lost their husband and father, as well as the breadwinner in their household. We assisted her with investigating the case and instituting a loss of support claim as a result of medical negligence. The matter was settled out of court. Although money could not bring back her husband, financial compensation would ensure that she could secure the best education and environment for her children, just as her husband would have provided.

Amputation claim

Bonny, an active and fit woman in her early thirties, felt a cramp in her leg while exercising. Realising that this was not a normal cramp, she rushed to the emergency room to have it examined. It was later determined that she suffered an infarction (loss of blood supply due to an embolism) in her left leg which went misdiagnosed for three days. As a result, she suffered muscle death in her calf and emergency amputation of her lower leg had to be done. We represented her in her case against the hospital and instituted a claim for medical negligence. After suffering such a traumatic event, she realised that monetary compensation would never restore her leg, but it would lessen the additional financial burden that she would have suffered. We successfully claimed for compensation to cover her medical and related expenses, home adaptations, cost of an automatic motor vehicle, loss of income as well as general damages for pain and suffering, loss of enjoyment of life and disfigurement.

Wrong medication claim

Mike had suffered with blood pressure problems and had been placed on chronic medication for this. He handed in his script at his local pharmacy and drank his medication as per the instructions. After a week or two he realised that he was feeling more and more unwell, and he ended up in hospital. He consulted his doctor about the possible side effects of the medication he had been taking. It was then that they realised that the pharmacy had dispensed the incorrect dosage of medication. Instead of 10mg tablets x2, he had been dispensed with 100mg tablets. This overdose resulted in toxicity and irreversible kidney damage. Mike had to undergo dialyses, will require medication for the rest of his life and face a kidney transplant in future. The pharmacy group acknowledged their mistake and Mike’s case was settled out of court.
